Where's YOUR Towel? Photo Contest Rules

1. SPONSOR. PeopleTowels, Where’s Your Towel Photo Contest is sponsored by PeopleTowels, LLC, 455 Canyon De Rey Blvd., Monterey, CA 93940, (“Sponsor”).

2. ELIGIBILITY. You must be at least 18 years old as of the start date of the Contest. Employees, shareholders, officers, directors, agents, representatives of Sponsor and their immediate family members and those living in their household, and each person or entity connected with the production, administration or judging of the Contest, and each parent company, affiliate, subsidiary, agent, and representative of any aforementioned entity are not eligible.

3. HOW TO ENTER. Photo submissions accepted from 8:00 am EST May 9th – 12:00 pm EST May 22nd on PeopleTowels’ Facebook page. Multiple submissions allowed. Each submission must be a unique photograph. Sponsor reserves the right to reject any photograph that does not meet the above criteria, and which in its sole judgment is deemed inappropriate subject matter.

4. SUBMISSION GUIDELINES. Entries will be considered eligible if they meet the following criteria:
Entries must not contain material which is, or promotes, activities which are sexually explicit, obscene, pornographic, violent, self-mutilating, relating to murder, the sales of weapons, cruelty, abuse, discriminatory based on race, sex, religion, natural origin, physical disability, sexual orientation or age, illegal such as underage drinking, substance abuse, computer hacking, offensive, threatening, defamatory, profane, or harassing; or material that contains any derogatory references to Sponsor or any other entity deemed inappropriate in Sponsor’s sole discretion. Entry must be entirely original to the Entrant and must NOT include mention or performance of any copyrighted material including but not limited to music, films, books, television programming, or identifying descriptions of any media property without permission. Sponsor is not responsible for legal protection or clearance of Submissions in any form. If, in the sole discretion of Sponsor, your Submission constitutes copyright infringement, the Submission will be disqualified. Contestants agree to indemnify Sponsor, and its officers, directors, employees and agents against any and all claims from any third party for any use of Submission by Sponsor. All Entries will be subject to the PeopleTowels Entry rules and legal terms contained in this document, the official rules (“Official Rules”).

5. JUDGING. During the Submission Period, Sponsor may post and exhibit Entries on Sponsor’s Facebook page or website, www.peopletowels.com. Posting of Entries does not give Entrant a greater chance of winning.
On or before May 25, 2011, Sponsor will select two (2) winners based upon:
1. A photograph that best exemplifies a picture of a PeopleTowel in use;
2. A photograph that best demonstrates a location with demonstratable paper towel waste.
A 3rd winner will be chosen by popular vote on PeopleTowels Facebook page between May 23 and 24, 2011.
Winners will be announced on or about May 25, 2011 (“Announcement Date”) on Sponsor’s Website and Facebook page.

6. PRIZE. Subject to verification of eligibility: An eco-swag bag containing at least:
Five (5) PeopleTowels, A Blue Avocado Grocery Bag, a Lunchskin sandwich bag, bamboo cutlery, a stainless steel water bottle.

All prizes will be delivered by U.S. Mail or overnight carrier (i.e., FEDEX, UPS), within Sponsor’s sole discretion, to an address provided by the Contestant. All federal, state, and local taxes and other expenses in connection with the prize not expressly described herein as being awarded are the sole responsibility of the Selected Contestants. Selected Contestants are solely responsible for any other unspecified expenses related to prize, excluding shipping and handling costs. All activities related to the prize are at the Selected Contestants’ own risk and subject to whatever restrictions are imposed by the entities that govern activities. In the event of noncompliance with the foregoing requirements or if prize notification is returned as undeliverable, prize will be forfeited and, at Sponsor’s discretion, an alternate Selected Contestants will be selected. In the event that insufficient qualified entries are received, Sponsor reserves the right, in its sole discretion, to not award all prizes.

8. CONDITIONS. Contest is subject to these Official Rules. By participating, entrants agree: (i) to be bound by these complete Official Rules and the decisions of Sponsor which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law.

All photographs and other submissions disclosed, submitted or offered to Sponsor in connection with this Contest shall be and remain Sponsors’ property. Such submission shall constitute an assignment to Sponsor of all worldwide rights, title and interests in all copyrights and other intellectual property. By accepting a prize, Selected Contestant agrees to release Sponsor, including its subsidiary and any affiliated entities together with the respective directors, employees, officers, licensees, licensors and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Contest, (collectively, the Releasees) from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of Prize or participation in any prize-related activities. Sponsor shall not be liable for: (i) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (ii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iii) any injuries, losses or damages of any kind, including death caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (iv) any printing, typographical, administrative or technological errors in any materials associated with the Contest. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest. Sponsor reserves the right to cancel or suspend the Contest, in its sole discretion, should it receive fewer than 20 entries, or due to circumstances beyond its control, including natural disasters. Sponsor may, in its sole discretion, cancel, modify, or suspend the Contest should a virus, bug, computer problem, unauthorized intervention, or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit an entrant from participating in the Contest or winning a Prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or any other unfair playing practices of intending to annoy, abuse, threaten, undermine or harass any other players or Sponsor representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Disputes regarding these Official Rules and/or this Contest will be governed by the internal laws of the State of Florida.

9. PUBLICITY. Sponsor reserves the right to use the entry submissions to the Contest for publicity purposes prior to or after the Contest end date, in any media, and to use the name, likeness, hometown name, of any Contest entrants, including all or part of their submitted design throughout the world, without any compensation or prior review unless specifically prohibited by law. Taxes, if any, are the sole responsibility of Selected Contestant, and entrants may be issued an IRS Form 1099 for the awarded prize. This Contest is void where prohibited or restricted by law, and subject to applicable federal, state, provincial and local laws. Sponsor reserves the right to disqualify any entrant it finds to be tampering with the entry process or the operation of the Contest or violating these Official Rules.

10. PRIVACY. All personal information collected by Sponsor will be used for administration of the Contest and in accordance with Sponsor’s privacy policy only. Any questions regarding privacy matters should be directed to the address set out below. Please refer to Sponsor’s privacy policy located www.peopletowels.com/privacypolicy for important information regarding the collection, use, and disclosure of personal information by Sponsor.

11. OFFICIAL RULES and WINNERS LIST. For a copy of these Official Rules or the Winners List (available after the Announcement Date) send a self-addressed, stamped envelope (WA, VT residents need not affix postage) to: “PeopleTowels,” 455 Canyon Del Rey Blvd., Monterey, CA 93940.
